Terms & Conditions

Last updated October 29, 2026

The short version

  • The website is for general information. It is not a quote, a diagnosis or professional advice for your specific system.
  • Prices and estimates on the site or by phone are not final. Your price is set in a written estimate or agreement you approve before work starts.
  • Some website content is written with help from AI tools and reviewed by our team. It can still contain mistakes.
  • Disputes go to individual arbitration in Utah, not class actions. You can opt out within 30 days (section 16).

1. Agreement to these terms

These website and service rules ("Terms") are an agreement between you and Your Comfort Heating & Air (also doing business as Your Comfort Plumbing, Heating & Air), located at 503 S Main St, Brigham City, UT 84302 ("Your Comfort Heating & Air," "we," "us" or "our"). They govern your use of yourcomforthvac.com (the "Site") and any requests, estimates and communications made through it. By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy, including its Your Privacy Choices section. If you do not agree, do not use the Site.

You must be at least 18 years old and able to enter a binding contract to request service. If you request service for a property, you confirm that you own it or are authorized to arrange work on it.

2. Our services

We provide residential and light commercial heating, air conditioning, heat pump, ductless, indoor air quality and plumbing services in Brigham City and Northern Utah. Services described on the Site are examples; availability, brands and service areas may change without notice. All field work is performed under a separate estimate, invoice, work order or service agreement ("Service Agreement"). If a Service Agreement conflicts with these Terms, the Service Agreement controls for that job.

3. Estimates, pricing and scheduling

  • Any price, range, "starting at" figure, promotion or estimate shown on the Site or given by phone, email or text is an estimate only and is not binding. Final pricing depends on an on-site evaluation and is confirmed in a written estimate or Service Agreement that you approve before work begins.
  • If we find conditions during the job that could not reasonably be seen beforehand (for example hidden damage, code violations or failed parts), we will explain them and get your approval before doing additional paid work.
  • Appointment times are arrival windows, not guarantees. Weather, emergencies and parts availability can cause delays. We are not liable for delays outside our reasonable control.
  • Promotions and coupons have the terms, eligibility and expiration dates stated with them, cannot be combined unless stated, have no cash value, and may be changed or ended at any time.

4. Maintenance plans

Our VIP Maintenance Plan is sold for an annual fee (currently $240 per year) and includes the inspections, discounts and priority benefits listed on the plans page at the time you join. Plan benefits apply only to the enrolled system and address. The plan does not renew automatically unless you authorize renewal. You may cancel at any time by calling or emailing us; if you cancel before your first visit, we will refund the full fee, and after a visit has been performed the current year's fee is not refundable. A maintenance plan is not an insurance policy or a warranty against breakdowns.

5. Financing

Financing is offered by third-party lenders (currently GoodLeap), not by us. All financing is subject to credit approval, and rates, terms and payments are set by the lender in your loan agreement. We do not guarantee approval or any particular rate. Your loan is a separate agreement between you and the lender.

6. Payment

Payment is due when work is completed unless your Service Agreement says otherwise. We do not take card payments on the Site. Card payments made in person or by phone are processed by a PCI DSS-compliant payment processor. Past-due balances may be subject to the fees stated in your Service Agreement and the remedies allowed by Utah law, including a mechanic's lien where permitted.

7. Warranties on our work

Equipment is covered by the manufacturer's warranty according to the manufacturer's terms, which may require registration and regular maintenance. Any workmanship or labor warranty we provide is stated in writing in your Service Agreement or invoice, and only that written warranty applies.

8. No professional advice; no guarantee of results

Articles, guides, checklists, cost information, energy-savings figures and other content on the Site are general information only. They are not an inspection, diagnosis, engineering or safety advice for your home. Do not attempt gas, electrical, refrigerant or plumbing work yourself based on the Site; if you smell gas, leave the building and call your gas utility or 911. We do not guarantee any particular result, energy savings, utility bill, indoor air quality level or equipment lifespan.

9. AI and automated content

Some content on the Site, including articles, guides and descriptions, is drafted with the help of artificial intelligence tools and reviewed by people before it is published. If we add automated tools in the future, such as chat assistants, schedulers or cost estimators, their answers are automated and illustrative. Despite human review, AI-assisted or automated content may be incomplete, out of date or wrong, is not professional advice, and is not a binding quote or promise. Always confirm details with our team.

10. Use of the Site

We grant you a limited, personal, non-exclusive, revocable license to view and use the Site for your own non-commercial purpose of learning about and requesting our services. You agree not to:

  • use the Site for any unlawful purpose or to submit false, misleading or someone else's information;
  • send spam, malware or automated submissions, or try to bypass spam protection;
  • scrape, copy, frame or republish Site content, or use it to train AI models, without written permission;
  • interfere with the Site's security or operation, or try to access systems you are not allowed to access.

11. Intellectual property

The Site and its content — text, photos, graphics, logos and design — are owned by us or our licensors and protected by copyright and trademark law. "Your Comfort Heating & Air" and our logo are our trademarks. Manufacturer names and logos belong to their owners. Except for the license above, no rights are granted to you.

12. Your submissions and reviews

You are responsible for what you send us. If you send us a review, testimonial, photo or suggestion, you give us a non-exclusive, royalty-free, perpetual license to use it (with your first name and city) to operate and promote our business, and you confirm you have the right to share it. We do not pay for or alter reviews.

13. Third-party services and links

The Site links to and uses services run by others — for example Google Maps, review sites, social media, manufacturers and our financing partner. We do not control them and are not responsible for their content, availability or practices. Your use of them is governed by their own terms.

14. Disclaimers and limits on liability

THE SITE AND ALL ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not promise the Site will be uninterrupted, error-free or free of harmful components. Warranties for our field work are only those stated in writing in your Service Agreement.

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR LOSS OF USE, ARISING FROM THE SITE OR THESE TERMS. Our total liability for any claim arising from your use of the Site is limited to $100. For claims arising from services we performed, our total liability is limited to the amount you paid us for the specific service that gave rise to the claim, unless your Service Agreement says otherwise. These limits do not apply to liability that cannot be limited by law, such as liability for gross negligence, willful misconduct or personal injury caused by our negligence.

15. Indemnification

You agree to defend, indemnify and hold harmless Your Comfort Heating & Air and its owners, employees and contractors from any claims, losses, damages and costs (including reasonable attorneys' fees) arising from your misuse of the Site, information you submit, or your violation of these Terms or of anyone else's rights.

16. Disputes: informal resolution, arbitration and class-action waiver

Talk to us first. Before filing any claim, send a written notice describing the problem and what you want to [email protected] or to our address above. We will try in good faith to resolve it within 30 days.

Binding arbitration. If we cannot resolve it, any dispute arising from or relating to the Site, these Terms, or our services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in or near Box Elder County, Utah, or by video or phone if you prefer. The Federal Arbitration Act governs this section. Either party may instead bring an individual claim in small claims court if it qualifies. Either party may also file a mechanic's lien or seek emergency court relief to protect property rights.

Class-action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of more than one person.

Your right to opt out. You may opt out of this arbitration section by sending us written notice (email is fine) within 30 days after you first agree to these Terms. Opting out does not affect any other part of these Terms. If this section is found unenforceable for a claim, that claim will be heard in the courts described in section 17, and the class-action waiver still applies to the fullest extent allowed.

17. Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Subject to section 16, any court proceeding must be brought in the state courts located in Box Elder County, Utah, or the federal courts for the District of Utah, and you and we consent to those courts.

18. Changes, termination and general terms

  • We may update these Terms at any time by posting the new version here with a new date. Changes apply from that date and do not apply to a dispute already noticed under section 16.
  • We may suspend or end your access to the Site if you violate these Terms.
  • If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver.
  • These Terms, our Privacy Policy and any Service Agreement are the entire agreement about the Site. You may not transfer your rights under these Terms; we may assign them to a successor business.
  • Sections 8, 9 and 11 through 17 survive any end of these Terms.
